Judicial scandal: Justice Logoh challenges legalities of impeachment proceedings

LawJustice Mohammed Habib Logoh, a High Court Judge cited in the judicial bribery scandal has filed a writ at the High Court challenging the legality of impeachment proceedings against him.

The suit cited Tiger Eye PI, the Chief Justice Georgina Theodora Wood and the Attorney-General, Marietta Brew Appiah Oppong as defendants in the case.

Justice Logoh and 11 other High Court judges were captured on video allegedly taking bribes to influence the verdict on cases before them.

Justice Logoh is demanding total of 10 reliefs from the High Court to declare that the purported audio-visual recordings and transcripts in which the Plaintiff (Logoh) was allegedly captured is unlawful and amounted to entrapment.

He said the court should declare that the Directive given through the third Defendant (Attorney General) for the second Defendant (Chief Justice) to use the audio-visual recordings and transcripts as a basis to commence impeachment proceedings against the Plaintiff was null and void and of no legal consequence whatsoever.

“A Declaration that the action taken by the second Defendant pursuant to the said directive is equally null and void,” he added.

The High Court Judge contended that the court should declare that the second Defendant has no right to violate existing law or legal right of the Plaintiff under any colour.

Justice Logoh was seeking from the court an order of perpetual injunction restraining the first Defendant, its Chief Executive Officer, workmen, privies, and agents whosoever described from public screening of the said illegal audio-visual recordings.

“An order or perpetual injunction restraining the second and third Defendants from relying on the said audio-visual recordings and transcripts in any proceedings howsoever described,” he added.

He prayed the court to award cost including legal fees and any other order(s) that the Court may deem fit to make.
