Supreme Court adjourns Dr Zanetor’s case to May 3

An application filed by Dr Zanetor Rawlings, National Democratic Congress (NDC) parliamentary candidate for Klottey Korle Constituency challenging the capacity of an Accra High Court to hear a case concerning her candidature, has been adjourned to May 3.

The Supreme Court which was to hear the case on Tuesday April 26, did not assign any reason for the adjournment.

Nii Armah Ashitey the incumbent Member of Parliament who lost to Dr Rawlings in 2015, had gone to court challenging his defeat in the November 11 primaries citing some constitutional breaches.

According to Mr Ashitey, Dr. Zanetor Rawlings did not qualify to be elected as the parliamentary candidate since at the time of the contest she was not a registered voter in the country.

This he said was a serious constitutional breach.

Lawyers for Dr. Zanetor Rawlings however believe the High Court cannot hear the matter as it is rather the Supreme Court which has the jurisdiction to hear the case.

Dr Rawlings is therefore seeking a restraining order to stop the trial judge from hearing the case at a High Court.

The statement of case issued by lawyers of Dr. Rawlings is seeking “an order of prohibition directed to Justice Kwaku T. Ackah Boafo of the High Court.”

The suit is seeking to restrain the trial judge from proceeding to hear the dispute between Dr Rawlings and the parties in the case.
