Non-compliance of Data Protection Act punishable – Commission

Data centreThe Data Protection Commission, is to initiate prosecution measures against organisations, companies or individuals who have failed to comply with the Data Protection Act, 2012 (Act 843).

The Commission in April reminded organisations who perform functions as data controllers to comply with their mandatory requirements and register with the Commission.

This was in a statement signed by Mrs Teki Akuetteh Falconer Executive Director of the Commission and copied to the Ghana News Agency in Accra.

The statement said it is worrying that regardless of these extensive and comprehensive notifications, many affected organisations and companies have not complied with the notices and are defiant to the May 31, deadline to register with the Commission.

It said the affected organisations, companies or individuals are those who handle personal information such as administrative, employment, financial, telecommunication, medicals, education/childcare, security, legal and criminal records.

The Commission urged individuals who are mandated to register with the body as they serve as data controllers by collecting large amounts of personal information to do so to avoid sanctions.
