Australian mining firm, Adamus Resource Limited sued for surface mining
Some elders of Teleku Bokazo in the Ellembelle district have filed a suit at the Sekondi High Court seeking interlocutory injunction on the Adamus Resource Limited, a gold mining company, from undertaking surface mining on their land.
Mr Ishmael Gillie Carson of Hendricks Chambers, moved the motion last Tuesday on behalf of Ebusuapanyili of Teleku Bokazo, Ebusuapanyili Nwiaku Nda in the Ellembelle District of the Western Region.
The plaintiffs prayed the court to restrain Adamus Resources Limited from undertaking surface mining on their land until the final determination of the case.
They also sued the defendant for general damages for trespassing, recovery of possession and an order of perpetual injunction for further interfering with the said land.
According to the Elders, Adamus Resources Limited is engaged in surface mining on their land without their consent and permission.
They said that despite persistent protests by them and family members, the defendant was adamant and bent on carrying on with the mining operations on the said land.
The Elders argued that although the State grants prospecting and mining licenses to mining companies, holders of such licenses are bound to enter into proper negotiations with the land owners who are vested with the surface rights.
He said the harm caused to the environment by mining activities especially surface mining such as pollution of water bodies, vegetation and the environment is enormous.
